Experience certificate with job duties

Hi All,

 

I am Sartaj, I am working as a software Engineer. Recently I have applied for immigration, and Immigration department wants the experience certificate with my job duties and skills. My Ex company has given me certificate without job duties which only states "I was working as a software engineer from so and so dates".

 

From two months I am requesting my Ex company to give me the experience certificate with job duties that I was performing. But every time they are just rejecting my request telling that company cannot change the format according to employee needs, and now a days they are not at all replying to my mails.

 

Can anyone please suggest me if there is any India law which helps me to send them legal notice for this case. Or at least I can scare them by send them the law number.

 

If there is no law then please suggest me what needs to be done.

I am attaching the certificate with my job duties for reference.

The IESA prescribes issuance of service certificate.

If Hr is not yielding to your representations you may resolve the mater by approaching good offices of your appointing authority,MD,Chairman,Compnay Secretary. You may take up a stand that while company had described the KRA's of your post/designation applicable to you {employee} in appointment letter, standing orders { if any}, HR policy, employee rule book, and had assigned specific duties to b perfromed by you from time to time why the company should shy from writing the duties performed by you on paper in service certificate dispatched to you{enclose copy}.

You may also attach a model language suitabel to you and list all duties assigned to you and perfomed by you. If you can site the company docs  e.g. appointment letter, company's employee rule book, emails etc it shall be good.

Remain gentle but firm.

Your lawyer would know which law is to be cited.

The state of Karnataka has ended the blanket exemption granted to IT/ITES industry from IESA.

     (a)   Every   workman   shall   be   entitled   to   a   service   certificate,   specifying   the          nature of work (designation) and the period of employment (indicating the

         days, months, years) at the time of discharge, termination, retirement or

         resignation from service.

Ask them to affix company seal and send a soft copy by email also from company’s official email id to your email as recorded with company and as supplied by you.If the good offices also do not provide relief send reminder with a copy to ALC/DLC in local o/o Labor Commissioner with a copy to Labor Commissioner. This may work.

dear all 

Request to  give the full details of lay off process

1)     wHAT IS LAY-OFF

2)     NOTICE IS REQD. FOR LESS THAN 50 nos.notice period

3)     If below 100 nos is it notice reqd. if so how many days.

4)     more than 100 nos how many days notice reqd.

5)     In case of long term  what the employer has to do after 45 days,

please do the need full
