Eye witness is not available

Hello,

I am new to this site and a victim of 498a case. I just want to say that some people who where present during my marriage talks and so of my wedding are not within premises and my case need their evidence. Can you please tell me whether there is any provision of video conference in the court and if so can you refer any such judgements.

Your time and effort would be appreciated.

Video conference is meant for the people only who suffer from chronic ailments and who are age old and who cannot move from the bed.  It is allowed in rare cases only.

Thank you for sharing Sir. In my case they are abroad, aged and spending time with their children.

We cannot ask them to come to India to give evidence in court as it would'nt be nice (You understand what I mean). They are happy and we don't want to disturb them. But they will help us any time. Now, is there a provision to get connected to them in court when they are abroad. If so please let me know.

Examination of witness through video conferencing is permitted  in law.  You have to explore the possibilities by complying to the requirements set therein.  Consult your advocate to make use of this facility.

It would be dependent on the trial court if that permits the examination of such witnesses through Video Conferencing.

You are welcome, please clarify about the availability of  video conferencing facility in the court the trial is going on and comply with the requirement accordingly.

Request you to go through my each post carefully. It might helpful to you. Please go for seedy trial and compel them to come to the court else the judge will issue warrant against them.

 

Speedy Trial is mandatory in 498A
