F&F amount pending

Hi

 I have worked with Metric Telecom Networks Pvt. Ltd.(Gurgaon) for 1 year.  I resigned from organisation on 15th Dec. 2011 and released on 26th Dec.2011.But still my Full and Final amount is pending.Whenever i called in company they are saying that we have financial issue thats why they can not provide my F&F.

     It is more than 2 and half month passed me to left the company but till now no response from my previous Employer(Metric Telecom Networks Pvt. Ltd) side .So kindlly suggest me how i can get my Full and Final amount.

You may send an email to all company employees whom you have called on phone and mention that on dated........you have called him/her on phone and asked to supply you the payment of your dues by Bank DD only thru redg post only and you were told that the same shall be supplied to you by dated.......however the same has not been supplied and payment of your dues is delayed by ..........month/days and same should be supplied to you immediately.

Thereafter you may submit a gentle representation by letter thru redg post addressed to the good offices of your appointing authority, MD, Head-HR, Company Secretary and mention all representations made by you so far giving complete details e.g. date of all phone calls, your phone number(s)  from which calls were made, company employee's phone number, names/designation/departments and point out that despite your unlimited number of representations your earned wages and dues have not been paid till date and every time a new date for payment is given., and you are seeking intervention by good offices to supply you the following : ( give details) say with in next 7 days by by Bank DD only thru redg post only and a self addressed postage prepaid redg post envelope is enclosed herewith.

If the good offices do not provide relief you may submit a reminder say after 8 days and if no relief is granted you may approach O/o Labor Commissioner/Wages Inspector.

Or you may approach a competent and experienced service lawyer and you lawyer may prefer to issue a legal notice.

Dues should ideally be paid on last day in office or within next 2 days.

issue ;legal notice to the co., to pay arrears of salary, otherwise file a suit.
