Can the Factory inspector, in case of an accident, send report on Form EE, under rule 11 of the Compensation Rules, to the Commissioner under WC Act, if the factory is not amenable to the Factories Act? (i.e. the unit is not a factory as per sec 2(m) of Factories Act, 1948) Please note that under the circumstances, he is not competent to investigate the accident, if occurred, and, no investigation has been carried out in the said factory under sec 90 of the said Act
