False affidavit

My brother's wife filed a sworn affidavit before court requesting dissolution of the marriage. She mentioned various monetary aspects which are blatantly false. We have irrefutable bank evidence showing they are holding on to our  assets. Once our lawyer told her we were going to contest the case, she withdrew the cruelty case immediately before we were served saying she "did not want to press the case" - making it seem like an absolute withdrawal.

Can we file for perjury now since we can easily prove she lied on oath in the affidavit?

No.


Here summons were not served and havent undergone thru trail and the case is withdrawned.

(***) When the case is running or the case is decided, Upon application to the court, then only the court will consider, When the case is running, if the plaintiff gives an unconditional apologies to the court about the act done, then the court will condone the act

will your case comply with the above requirements?

when there is no case at all, how can you file perjury?
