False FIR

Hi,

 

The FIR contains a specific allegation of offence mentioning date, time, place and people involved.  The FIR also contains vague allegations without mentioning date, time, place and people involved .

The chargesheet contains only vague allegations with no date, time, place and people involved in the offence.

 

Is it compulsory for the I.O to give some sort of report (either positive or negative) when a specific allegation is registered in the FIR?  Or can he ignore the specific allegation filed in the FIR and file a chargesheet based on vague allegations?

The IO is bound by law to investigate the matter and produce his report upon the facts mentioned in the FIR

scope of quashing FIR is very limited, that too when charge sheet has been filed. petition to add charges under section 216 cr.p.c may serve the purpose. If u can adduce further evidence in that regard, you can also file a petition under section 173(8) cr.p.c for further investigation.
