Family Problem [need Help]

Hi Sir,

 

I am basically located in Mumbai. I got married 8 months back and i have not taken any dowry.  After Marriage lot of problems from girl side, like she don’t want stay with my parents, So she  gone to her parents city chinchwad.

 

I spoke with my wife and  convened like presently they wont stay with me, But later stage I need to look after them. Then my wife parents told, I have to give some money or some land to my wife then only they will send her daughter, But I dined and they approached police by putting a false case.

 

Police call myself and my parents and my wife’s parents and had a counseling, And then after 1 month, simply my wife came to my house. Till that time 4 months no problem. But now they are planning  to demand  some land on their name.

 

My doubts :-

 

1)     If they put any false case, what precautions I need to take.

2)     If they want to divide from me, Is my wife will get any right on my property. As I have 10 acres on my name and it came from grand father & I am the only son to my parents.

3)     If I gave my land to my parents as a Gift Deed, What are the complications.

4)     My wife is a educated not doing any job at the moment.

5)     If my wife again left my home with out informing me, what I need to do. Can I approach legally or any other way to protect my self and my family.

6)     Since 6 Months my parents are not staying with me, In that case. If she file a case as harassment  on my parents. How can protect them.  Because my parents are very old and they can’t digest  to go police station other formalities. But I can face any situation.

7)     If I want protect my self, what type of evidence court will accept i.e Phone Calls or any other [please tell me what type evidences I need ]

8)     Unfortunately if I died, Is there any right on my property  to my wife [presently I don’t have kids, If I had kids, How legal rights will be applicable to my wife and my Kids and my parents.]

relationship between wife and husband cannot be built on technicalities.

 

if there is no love bonding your relationship,whatever you do is waste.

 

in case of your death,your properties will be divided among surviving legal heirs .(Naturally wife also would included).

in case of your death the property will be divided equally betwwn your parents anf wife too.

I advice you to follow up some legal advise.

One solid way is that you can transfer your property to your parents without the knowlege of your wife as she can not do anything afterwards, but if she came to know that you are planning to transfer whole the property they she can take legal action to transfer to her also. Once the property will be transfer then she cant do anything.

i agree with preet. further your parent should make a registered will for their property also. and in case if she left your home then approach the court at the earliest and applied for A.C.B. for your self and also for your parents. also collect the certified copies of entire police complaint, counselling and settlement. you must make a registered  will in respect of your remaining property for the safe side.
