Family Property

Hi there , My late Grandfather was left with a son(my unckle) and two daughters(my late mother and my alive aunt) my unckle is in possession of our grandfathers property from last 35 years and he did not distributed the property to my mother and aunt who are the legal heirs of my grandfathers property. now my unckle wants to give us 50 lakhs and wants to get a NOC from our brothers, my unckle says that is what our share is in the property of my grand father. the overall preoperty is worth about 100 crore. can you please advise as to what should i do and who to contact for more details , is my unckle right by giving us only 50 lakhs worth of property for our share. please advise.

I think your family is govern by mohemaden law.

In my opinion is better to accept  50 lakh Ruppees from your uncal.Because under mohemaden law. there is no provision of equal share. there is also no provision of co -parcenary propery.

If the property is govern by Mohemaden Law it is better to accept  50 lakh Rupees from your uncle.

Adinath is right. because your mother had got no legal right to claim any share in the property being governed by mohammadan law, so better to accept what is offered rather awaring your uncle...
