File 498a without involving husband

Can any one tell me about that, a wife filed a false 498A against her in laws except her husband (due to husband tell her that sue to my family or threat them for giving share is in property as soon as possible). Then, if she filed, then what will happen to her family, Is it bailable or un bailable case & what will be the judgement i.e., fine or jail.

Dear Bikash

the wife can filed the false 498A and other cases against them but if the court acquttal all of them or anyone they/he can be file a cross case against wife for malicious prosecution and defemation.

secondly if the wife states before the cpurt in cross examination or in her cross examination she can go to jail along with her husband.

What a strange situation.....husband & wife conspiring against parents 4 a criminal case. Anyways if such a lady becomes successful, 498a is Non-Bailable, Non-compoundable, Cognizable. Penalty is 3yrs jail max.

Practically........much better ways exist to blacken ur face!

But can you tell me that, what any type of action will be taking by his parents & siblings for refuse & shows the case is false, due to case is not filed & not make any FIR till now (Both are only think about taking this type of action).
