Dear Learned Members,
In a civil case one of the two defendants has not attended the court even for a single day or got a vakalat filed on his belahf and the other defendant has been able to get the case dismissed after a three years. Now the second defendant who never attended the Hon'ble Court since the begining of the case or filied vakalat is coming and filing Vakalat. Is this filing of Vakalat allowed?
Kindly help me with a reference Judgement or Citation from CPC that prohibits such filing of Vakalat.
