FIR and Investigation in 498a

Respected Ld Members,

 

In 498a are there any orders/ciruclars/ that,

POLICE can Reg FIR and do investigation and also can come to the house and take the

accused to the POLICE STATION without any instruction from the DCP/ACP/Superiors.

 

Luckily in this instant case accused did not go to the POLICE station but asked permission that, he  will come later

 

But, i request you to  please tell the correct procedure[with CrPC code] on this issue

Section 498-A  of IPC is a cognizable offence. In every cognizable offence  police is  authorise to make investigation. Police  is authorise to summons the person against whom  offence is registered.If the primafacie  offcence is made out against the  person, in that case  police  can arrest the person without warrant.
