Firstly, you should serve a legal notice to the Builder asking him to deliver the possession within 15 days of the receipt of the legal notice, a along with interest and compensation for the period of delay.
If he fails to do so, you can file a complaint against the Builder in consumer court for deficiency of services and unfair trade practices adopted by the Builder by not giving possession seeking refund or possession within a month along with interest damages and litigation expenses.
