Floors sold without sanction plan

I am having a dispute with builder and a civil suit is already pending in court for declaration, damages and injunction.

The builder got sale deeds in his favour without first getting sanction from muncipal corporation to construct the building. The sale deeds were executed before the plan was sanctioned by the corporation.  

The building was originally a single storeyed building. After demolishing the original structure, the builder built four floors with stilt parking but got sale deeds executed from me by fraud for first, second and third floor when the floors which were being sold were not even in existence at that point in time.

I want to ask whether the municipal corporation of delhi can take action against the building or the builder on this issue.
