FORGERY

Can xerox of a Forged document be used as evidence against an accused on the basis of the opinion of handwriting expert? There is no witness who can account for the Forged document.

I don't think so ...

Example: What is the proof that you are showing a forged document which is a copy of the original document. It is possible to tamper such documents with existing technologies.

 ya u can used as evidence subject to if u have original of said zerox

I agree with both of them .... and if there are no witnesses to account for the forgery then a clear case of acquittal ...... but there would be a complainant ???

I believe that courts have to be very cognizant of the fact that xeroxed documents are very easy to doctor. Moreover usually the handwriting experts require the originals to figure out if forgery was done or not. It is impossible to prove if something has been substituted, added or deleted from a Xeroxed document. For important documents it should be incumbent on person to get a certified copy of the document when it is prepared or better still to get the document registered.
