Format of exemption Application to be made in the Magistrate Court

Can anybody givwe me the format of Exemption Application to be made before the

Magistrate Court.

APPLICATION UNDER SECTION 317 OF Cr.P.C


The undersigned begs to submit as under:


The accused no.              has been accused of offences punishable under section..........of IPC.  The accused is innocent and the offences are bailable oofences.  The allegations of the prosecution of untrue and challenged by the accused.  Th eaccused is appearing before the court on all dates of hearing.


The accused no.     is out of town due to attend...................... He is not likely to reurn from .................. today.  The accused No. will be present before this Hon'ble court on the next date of hearing.


.Wherfore it is prayed that the absence of the accused be exempted for this day

Sir,

     It is submitted as under: -

1.      That the above said case is pending in this Hon’ble Court and is fixed for today.

2.      That the counsel for the applicant has received a telephonic message to the effect that the applicant Gurpreet Singh is unable to attend the Hon’ble Court today, as the applicant is suffering from illness and is confined to bed due to very cold weather. Hence this application.

3.      That the non-appearance of the applicant in the case for today is neither intentional nor willful; rather, it is due to the above said reason.

It is, therefore, prayed that the application of the applicant may kindly be accepted and his personal appearance for today may kindly be exempted in the interest of justice.

                       at Muradabad ( U.P ) so, he could not attend the Hon’ble court for today.

               4.That the absence of the accused are neither intentional nor willful , rather , it is due to the above said reason.

  5.That the Counsel undertakes to inform next date of hearing to the accused.

Hello Sir,

In the exempt proceeding application, if the signature of the accused a must along with the signature of the advocate.

Does the same format apply to EP application in Karnataka Magistrate courts.
