Framing of charges

1. The case is at the framing of charges stage. What happens in this stage? Is there a discussion on how charges are framed or is the charge which section 326 accepted directly by judge.

2. When is the accused asked for his statement of guilty or not guilty? Is it during framing of charge or after charge is framed.

3. How crucial is framing of charge stage?

4.When is the accused asked to give his statement. Is it during framing of charge?

According to Section 228(2) of the Code of Criminal Procedure, where the judge frames any charge in writing against the accused when exclusively triable by the Court, the charge shall be read and explained to the accused and the accused shall be asked—whether he pleads guilty of the offence charged or claims to be tried.
