Fraud

Respected sir

We had employed a contractor for house renovation works.He took partial money 70,000 rs for the rennovation work on the pretext of buying materials .However he bought some material and started work and absconded midway . He is not picking up our calls and avoiding us . He also didnt pay The daily wage carpenters . We are senior citizens and member of  CGSI and cant manage such a grueling fraud.
i am attaching a payment slip signed by the fraud contractor. His name is Masroor Khan.
We also went to the police but as usual they are very uncooperative.

Please reply as to what can be done.

Dear Querist,

 

This clearly a case of cheating punishable u/s 416/417/420 IPC. If the local police refuses to entertain your complaint. File a simple application before your area magistrate who would definately order registration of FIR.

Before filing a complaint with the judicial magistrate under the relevant sections of IPC, you can approach the Superintendent of Police of your district and file an application before him under S. 154(3) Cr.P.C seeking action against the accused. If this does not work, file an application directly to the jurisdictional magistrate under S. 156(3) Cr.PC.
