Fraud builder

Consumers purchased flats on the 3rd and 4th floor of the newly constructed building. Builder has already delayed possession of the flats and builder has already gained 90% of the amount of each flat. Now, the consumers came to know that 3rd & 4th Floor of the building is illegal. And it is broken my municipality.

What is the remedy available to consumers?

But how? Does consumer have to go to Consumer forum for that purpose.
