Frustrated By Tenant!

This is a case of an frustrated Army personal, who rented his house to a tenant who refuses to vacate it & has also not paid rent. Facts of the case:

  1. Half portion of the premises in Mohali, Punjab is rented; in another half, the family of the Landlord stays.
  2. The Tenant has not paid rent for past 14 months.
  3. He has filed a case complaining that the landlord has cut off the electricity & water connections, which, I am told, is not correct. 

Now, can the fact that the landlord is in active service of Army (Re-employed),inter-alia, help him evict the tenant. Also if a compromise should be effected, then on what terms.

If your case does not fall under Rent Control act then simple suit is enough to kick this ass out.

Get Water or electricity re-established as soon as possible to dilute his complaint.

As your owner is a Govt. employee see the rent act of the land ,is there some  special provision for him like there are in Delhi Rent Act---under section 14.

Have you got any rent agreement--what does that say ,is also crucial.

Consider of compromising only after considering all these factors.
