One builder in Kharghar, Navi mumbai is developing Gaothan Plot in Navi Mumbai building 7 floors building on it. The only document builder has is "Sanad" of Gaothan Plot in the name of the owner from whom the builder purchased the land. Builder is trying to convince the proposed flat purchaser that the construction of the said building will be regularised by CIDCO. There is no tri-partie agreement available.
My questions are :
1. Will this construction be regularised by CIDCO?
2. What Clauses should be mentioned in the sale deed if one wants to purchase the flat in the building which is being constructed on the above mentioned Gaothan Plot to safeguard the interest of the Flat purchaser and also to make the indemnity of the Builder towards the loss of the proposed purchaser and any future consequences?
3. It would be grateful if one can give draft of Sale Deed Considering above Points.
