Garbage issue

Hi,

I am a resident of a Coperative Housing Society in Pune. There are total 7 buildings with ~300 flats. Recently the Society Committee members decided to construct garbage pits (Vermicomposting) to process the garbage waste generated by the society. The place identified to construct the pits was a vacant space, within the society, adjacent to one of the building blocks. No consenses was taken from the residents & 15 odd pits were created to process the garbage of all the flats. Unfortunately the pits did not function as expected resulting in HSW (Health Safety Wellbeing) of residents being compromised as the garbage was openly being dumped within the society. Also the place where pits were created was not allocated as 'Garbage Processing' area when the building plan was passed by authorities. Is there any way the residents of the society take legal actions against the Committie for creating pits when it was not part of the society plan passed & openly dumping garbage within the society compromising residents health? If yes, what would be the process?

this is major decision it must have to be passed in the AGM.check and reply whether it was passed in AGM.

if it is not passed in AGM then it is illegal.

Hi,

Thank you for your response...the desicion to create pits was passed in the AGM...However the location were the pits is to be created was not agreed in the meeting...Also pits were created adjacent to a block, within the society,in an area which was used for open parking. The pits became disfunctional & the place became a literal garbage dumping ground risking health of people staying in the block....Issue was raised with the local corporation and were told that creation of pits within the society was an internal issue and they had no say in that....Is there a legal way through which we could disallow the dumping of garbage within the society so that health of people are not compromised?

if it has been passed by AGM and u have raise the objection to it then only u can file a case otherwise not.


A simple Solution is to conduct Extra/Special General meeting and pass a resolution at such meeting for cancelling the garbage Pit resolution.

.it is simple and will save ur legal expense.
