Gift deed issue.

Hi,

Can you please suggest /advice whether the below is valid or not.

Issue: My mother elder sister has given one propery to my mother and another property to my mother elder brother as gifted 10 yrs ago. My mother elder brother has sold out the gifted property to some other person after two years from registration of the gifted property. But my mother still has not sold it. My mother elder sister ( who has given the gift) has adapted a daughter. Now the husband of adapted daugter is selling the gifted propery which was earlier gifted to my mother. is it legal? can we fight for this? is this property belongs to my mother?

please advice and let me know if any info required ?

The property has been gifted by your mother's sister to your mother through a registered gift deed. It is her property now and, therefore, no one but she can sell it.

Your mother is the absolute owner of the said property and no one has a right except her.Hence your mother can immediately lodge a criminal complaint of the said transaction aagainst the person intending to sell it'
