gift deed - reg.

Respected Sir/Madam,

I am from kolkata. we have an undivided property (2-storied old house) in the name of 3 out of which my father and big uncle died. now my another uncle wants to get my father's portion as gift deed (danpotra) from me. The house/property is said to be done legal partition deed before gift deed.

I want to offer him my father's portion as gift deed (danpotra) without doing partition deed. I do not want to bear expenses of partition deed when i gift the same to my uncle.

Please advise exact way out 🙏

If you are the lone successor to your father's share in the property, you can transfer the same to your uncle by a registered gift deed.

There's no bar to transfer undivided share in favour of him.

Though you can gift your undivided share in house  to your uncle but to avoid any complications or disputes it is advised first get partitioned the house and then make gift.

Valid question qua ownership of share of house / succession of share of other LRs (if any) of your father has been raised by expert.
