Gift of property

Dear Sir/Madam,

My uncle resides in Hyderabad in Telangana State with permanent address, , he owns a self acquired residentil plot in Vijayawada, Andhra Pradesh State.

Now, my uncle wants, to gift the above said plot (property)  to his son, but he is not able to travel long distance as he is of 94 years old.

Hence, can he execute the gift deed for the property located in Vijayawada, Andhra Pradesh state from the Sub-Registrar office, concerned located near his residence in Hyderabad, Telangana State.

If, yes, what is the prcedure ?

A property in a state cannot be registered in another state.  Your uncle may execute a POA in Hyderabd in favour of anyone to execute the gift deed for the property in Vijayawada of AP.  The POA shall be validated by the District Registrar concerned and after that, the agent can gift the property to your uncle's son on behalf of your uncle.

Gift deed can be registered with local (area) sub-Registrar only where property is located.

Your uncle should appoint an attorney in Hydrabad (TN) for registration of gift deed in Vijaywada (AP).

Thank you vermuch sirs, for your precious advice.

In this regard, one more query please.

Can my uncle execute POA in the name of his son himself, who is donee? so that the donee himself will go to Vijayawada and get the gift deed registered in his name duly attending all the formalities as per sub-registrar office, in Vijayawada, Andhra pradesh.

He can execute a registered power of attorney in favor of his son within the jurisdiction of his residence and specifically mentioning that he empowers his son to execute the registered gift deed on behalf of him unto his son himself,  this would remove the ambiguity.
