Google tracking data

As new reports reveal that google even tracks user data in the incognito mode (which claims that no data is being monitored or stored) isn't this violative of right to privacy?

Hello, Greetings of the day!

The lawsuit alleges that Google's incognito mode is in the violation of right to privacy as it does not inform the users that they are collecting data. US district judge, Lucy Koh stated, "“The court concludes that Google did not notify users that Google engages in the alleged data collection while the user is in private browsing mode."  
Due to which, google faced a $5 Billion lawsuit over tracking users for in incognito mode.
