govt servant doing two jobs earning salary

sir,

I have been said by a co. to make legal proceeding towards a employee of theirs as it is found that he is already workking in  delhi NDPL(electricity department) . Means what are the legal consequence if one person do two govt. jobs?

what are the act and rules for which he is liable to face legal proceeding and please give me case law regarding it.

What legal proceeding.

First simply write to NDPL that so and so is also working with you.  That is enough.  The employee would be taken to task by NDPL.  Thereafter on the same basis, you take action against him.  There ends the job.

if i want to send him legal notice pls guide me under which sections of which act.

I just want to do my home work before proceeding , thats why i want to study those acts and sections.

The private company can have no cause of actin against him. it is the PSU which will take acti9on.  I do not understand what type of notice you can given him? His has cause no civil wrong to your company [atleast as per the facts given by you]
