Gpa after death - land

Hello All,

 

My Uncle, being the owner of land, had executed a GPA with Mr X in 1992...later my uncle passed away in 1997. There were some sites sold by the GPA holder till1997.  

Later the survivor was my aunt...while she also has passed away in 2011. It has come to an absurd shock that, after 1997 there were lot of transactions(site - absolute sale deeds) executed refering to 1992 GPA,while no concurrence were taken from my aunt. Now when we enquired,

a. there are a few sites vacant without any sale deeds(legal or illegal) executed.

can we(me and my brothers being the class 2 heirs) take posession ofthe sites?

b. few vacant sites are illegaly registered after 1997. 

the issue here is ---we have been educated that, we have to pay the court fee based on current guidance value of the site...which we are not capable of? is there any resolution?

 

c. there are some sites, which were illegaly transacted after 1997, where buildings have come up?. how do we handle these.

 

i can understand the lapses from ourside, as neither my aunt bothered to lookafter the property after my uncle's death as she was not keeping good health and we were not in good terms with thier family either.

The Power comes to end with the dealth of the doner (Power of Attorney issuer), unless the Power of Attorney

was an irrevocable POA, given for a valuable consideration. Even in such cases, the power could be challenged

on various grounds. Consult a lawyer with complete detailsl and documents available.
