Gpa query

 

 

I am buying a flat in Vinod Nagar, East delhi and the dealer is saying they will no sale deed but they will just provide general power of attorney.


Has anyone bought a flat in these type of colonies recently? If any idea could you please let me know the procedure? Is it safe to buy a flat with GPA only?


Here almost every flat sale this way.

It is not legal to buy a flat only on the basis of GPA. The title will not pass to you unless a valid sale-deed is executed. Insist upon a sale-deed.

Please understand that a GPA is only an authorisation by the owner - allowing you to deal with the property ON HIS BEHALF, it in no manner vests any title in you (After Oct, 2011 SC Decision in Suraj Lamps). You have to have a registered sale deed in your favour in order to be the owner. Settle on nothing less.

Thanks Bharat! I was in wrong impression that GPA started again after it banned in Oct'2012
