Grand fathers property in mumbai

Hi There,

My name is Rashid, My grandfather died in 1969 leaving behind him his property, and he had two sons(one son and his wife died and no childrens from them) and two daughters (one of them my mom who died in 1981),

my uncle (one of the two sons of my grandfather) is holding my grandfathers property in mumbai, my aunt (one of the two daughters of my grandfather) is alive, and the property is not distributed as yet,

in 1979 there was a agreement between my father, aunt and my uncle. but this did not get implemented any time, in other words we did not get our share from our grand fathers property as yet.

my question is i tried all possible means (even sending a letter from a lawyer) for getting our share but my uncle says that he cannot give as he has so many children of his and their grand children who needs the property.

i know that its almost more than 30 years of my grandfathers death, can i file a case against my uncle, if so how can i do this. what is the process.

under muslim law the daughters are not entitled for equal rights over the property but still they get some share depending upon the number of children,you can file suit for get your rights over the property.feel free to call.
