Grandfather has made settlement his self acquired property

My grandfather has made settlement his self acquired property long years back 1950 ( land ) to his wife name ie., my grandmother , my grandfather has three son’s including my father ( 2nd son )  and one daughter  with grand children, son’s, grandfather and grandmother  all are passed away.

My grandmother has made gift settlement (1997) that so called land property mentioned above to the grandson of first and last son without my father concern/knowledge and gift settlement deed it’s clearly mentioned that the property nobody can’t claim or enjoy except that the grandson of first and last son mentioned in the deed.

 

If this is the case, Can I say I am also one the legal heir for the above property as the property was an family property and it was purchased during we are all live as a joint family and also there was no oral or written partition has not been made by my grandfather in our family property, please advice.

you have little chance to contest this case, your GRAND MOTHER do have all the right to transfer her property according to her wish.it is her property.

If you are able to prove that the property was originally purchased by your grand father out of joint family income or from the source of income arrived from your ancestral property, then only you can claim share over it.


In other words, you can not claim any right on the property if it was purchased by your grand father as his self acquired property.
