Grandfather's property

My grandfather (from my mohter's side) had 12 children. He died intestate in 1982 leaving behind some lands. Upon his death, GPA given to first son by all others. One of this daughters passed away in 1986. In 1990 Agreement to sell entered into by GPA holder for sale of lands . Advance Rs. 5,000/- received. 90 days given for sale conclusion. Purchaser files a suit for specific performance on 86th, i.e., 4 days before contract time expires.  We appoint an advocate. After a couple of years case decided ex-parte in Purchaser favour as our Advocate was not present. Filed Pettion and order rrecalled. matter stil pending. Three more daughters of grandfather have passed away in the last 5-6 years. GPA holder passed away this month. What is the position of the court case. We do not want to sell to the Agreement holder. Please advise about the position of the case. Also can we partition the property (not sell) when the case is pending
