My total years of experience is 5 years and 3 months, but i heard that, in the Fifth year i should serve minimum 190 days of service.
This is the policy i have take from my company policy
the gratuity amount is payable to the associate at the time of sepration or retirement whichever is earlier he/she has rendered continuous service for not less than five year and have actually worked for not less than 190 days in the fifth year.
So Please clarify this.., will i get gratuity amount ?

If you have worked for 190days in 5th year then you should be.
Have you submitted FormI under proper acknowledgment?
Has comany declined to pay in writing?

Actally i am serving a notice period now, company did not say anything right now but i saw the company policies. It is mentioned that the gratuity amount is payable to the associate at the time of sepration or retirement whichever is earlier he/she has rendered continuous service for not less than five year and have actually worked for not less than 190 days in the fifth year.

What is the private interpretation of actually worked by employer or its atorniey's in HR?

Actually employed should mean actually worked.

Elders of your family, colleagues, employee’s union leaders, an accountant, retired employee........... can also help and guide you.
Prefer them that are your own and known and close.
Then approach local senior counsel of unshakable repute and integrity specializing in concerned field of law ( e.g; labor/service matters as in your case).
Then approach lawful authority under expert and careful guidance of persons that are your own and known and close……………..and your local senior counsel.
