Gratuity shown in ctc

Dear friends,

I would like to get the information from my legal friends about Gratuity.  

If gratuity amount is included as a part of the total CTC of an employee, is the company liable to pay gratuity to an employee who has resigned and has not completed the stipulated 5 years continuous employment.

My view isd is 'Yes'.
