Guidelines for offrole employee

Hi All,


 

I AM AN ENGINEER WORKING AS AN OFF-ROLE EMPLOYEE TO A COMPANY. I'M INTERESTED TO KNOW WHAT ARE THE RULES AND GUIDELINES IF ANY SET BY GOVERNMENT REGARDING EMPLOYING AS OFF-ROLE TO A COMPANY AND BENEFIT SHOULD BE PROVIDED TO THE EMPLOYEE.

Off role employee may mean:

---You are working at a company but are on the payroll of another company.

Your employer is liable for ensuring faithful observance of laws and enactments applicable to it.

What is this establishment that has employed you and pays the wages to you: Commercial or Industrial?

You, Redg. office of the company where you are working, and company which have employed you are in which state?

Has it issued appointment letter and does it issue wage/pay slip, provides for PF, ESIC, Gratuity, Group Insurance, Form16 etc..................

If you are not employed by the COMPANY where you are deployed to work then have you been deployed as contractual worker by another company?

If yes then this COMPANY may become Principle Employer and if the company that has employed you fails the principle employer may have to provide for benefits mentioned above.

--- You are working at COMPANY but are not on the payroll of any company.

Probably the person/establishment/ which is extracting the work out of you are paying you in cash without getting any voucher signed from you.

This would be violation of labor laws and you can approach Labor Inspector, O/o Labor Commissioner.......................
