Harrassment due to judicial delay

Dear Sir,
         I Balkrishna Abaji More residing at Nigdi, Pune  44 wants to raise my voice in the matter of judicial delay and violation of Human Rights in India.I have been cheated by a person named Vilas @ Pravin Namdeo Kamble in respect of that I have lodge a complaint to Nigdi Police Station, in month of february 2011 Nigdi ,Pune 44 (District - Pune, State - Maharashtra) on 17-2-2011.  Till June 2011  I was waiting for police action but police have not taken any action in the said case I have informed the police that accuse is residing at Village - shahupuri, district Satara, State Maharashtra and I can show you the home he resides. More than 4 months had passed but police had not taken any action. So I filed complaint to state Human Rights Commission, Mumbai. Then Human Rights commission sent a letter to commissioner of police, Pune to investigate and filed further report in the month of August. Then after one month that is in October Police registered a crime but after that they did not proceed. hence after one month I apply under Right to Information act to Police about what have happened about my complaint from February to November. After 40 days from my application of RTI Police have not inform me anything. Now I want to put this matter in front of media as well as International forum about delay in judiciary as well as Government machinery. I will die in this fight but I will not keep quite. How long people will wait to get justice. I need help of the people who positively think about the society. Today if I go in the appeal in case of RTI it will take two years and information officer will be punished approximately 25,000. But what about my Justice. I have all the original documents relying on which accuss can be punished. I have shown it to police and supplied them xerox of the document. evenafter this police are not interested in taking any action.

             It is my earnest request to all you people that if you really think me get justice please at least tell me the way in which I will succeed in sending the accuse to the jail. Because today accuse is freely living in society and easily cheating people. and due to slow machinery he will cheat more and more people.

Dear Mr. More

You are not alone. Look at Anna Hazare, He is fighting for the common man at the same time same common man looking him down. In last 60 years non of the political party raised this point and addressed in the election

In India Politicians, Authorities, Jedges, lawyers are corrupt and hard to get justice. I am also victime of this system and helpless

Consumer court says people get justice quickly infact it took me 9 years

If you visit Mumbai Maha Nagarpalika H.O. you will see how many lawyers standing on the road to get clients and once they get client they will screw them

You want to know what you can do to get quick justice, actually you are doing best you can. Nothing more you can do in India. Lots of people actually died to get quick justice.Legal system is so much rotten that ordinary man like you and me can do nothing more

Keep faith on god and do what you are doing now

 All criinals know this. And our system is so designed that every body will go out to protect the accused.

Women are worst sufferers.

If before Lokpal , judicial reforms are brought in and conviction rate rises fro 1% to 50% and time is reduced from 10 years to 10 months, then corruption would reduce a little, and justice would bring fear in ind of criinals in indulging in further cries.

Dont be disheartened. Keep fighting at your own pace.Drive your strength from the fact that to punish Rathore for six months, it took Ruchika  malhotra s friend and family 19 years, life of Ruchika, and shattered life of his brother and father.

But that too was possible, only because her friend kept fightig her case.

So we have to go on  keep fighting at our own pace.

I was at Music Academy Hall today listening to the address by the eminent Judge.

From his speech I gathered that a Judge of any Indian Court has got absolute security for his job which simply means power without accountability of any kind. This absolute power has not corrupted them for long only for the reason that there is little chance that they could use their power to their advantage. Yes ... the Judges hear and dispose only the petition of the petitioners and not their own! Therefore the both the beneficiary and the victim of Judges of Indian Judicial system are the petitioners. As a petitioner I posed a solution to the moot point of the address of the Judge at the end but I was not happy with the response that I received.

In my opinion I differ from the Judge in regards to the suggestion he proposed regards to things like enhancing their retirement age to 70+, ensuring full salary pension to them etc. More and more the system provides them an absolute benefit ... more they are going to be corrupt. More security that they get from the system will see to that they are less accountable and so may not be responsible for the petitioners. The fact that they have absolute security - more than any other Constitutional Functionary - does not mean that they may not desire more for it is human nature to seek more. The mortal Judge will also try to secure similarly for his/her siblings and thus arrogate with his power to be corrupt in spite of any amount of security bestowed to his/her position. Therefore the mechanism of ensuring accountability in a fool proof manner is what is required to ensure Judicial Accountability and Transparency to the society.

The Collegium of Judges can always manipulate any profile by selectively valuing the reports and that the speaker concurred today in his address. It should be noted that almost all Judges put a very brave face to deliver justice in all matters that receive abundant media publicity. But it is only a trivial percentage of all the cases handled by him/her. The monotony of a Judge's work today is that he is listed with about hundreds of cases a day in the background of several lakhs of backlog cases and so the predominant attitude is to dispose as many numbers as possible. Majority of the petitioners suffer only because of this attitude and that is the prime reason for the public in India avoiding Judiciary for their issues. Therefore it is not fair to make any assessment of a Judge based only on the trivial percentage of the cases that he or she handled that got the media publicity. The system should generate a number for accountability from all the cases and that was my suggestion.

I suggested that a Judgement of an High Court that has been accepted in appeal in an higher court has to be defended for the Judgement by the same Judge. First this will make the Judge's work life more invigorating for he can at times practice his advocates skills for gaining perfection as a sweet holiday from the monotony of hearing about hundred plus cases a day. More importantly the Judiciary can now have a numerical figure for his merit on day to day basis that can be used as an index of accountability. I know that much more has to be deliberated to bring in a clarity in my proposition. But I find it odd that Justice Shah responding in a manner that it may not work when the public expectation is that the public offices in India should ensure that such system are in place and function without scope for much ambiguity. A number for measuring the accountability has to be studied and it will be a futile exercise to believe that a more autonomous and secured Judge will deliver genuine Justice demanded by the society.
