hold full and final

DEAR SIR,

 

I AM WORKING A sR.officer , after resignation  management hold my full and final settlemet .and they are sent  notice at my address for you are not maintain leave record and  giving excess leave for employee so why not your full and final settelmet dued not attchment for this.

but have not any wrong works this like , i thought going to labourt court or some .

 

please guid me to gettinga full and final settlement

It appears that you will not belong to "workman" category and hence, approaching the labour court may not solve your problem.

It is illegal to hold your full and final on the ground mentioned by the management.  Without holding any enquiry, they cannot come to such a conclusion and withhold your full and final.

Even though, it is a little bit costly affair, the remedy for you to recover that amount lies in filing a civil suit and the court fee would depend upon the amount which you would have to recover.  Once you succeed, the court fee also may be directed to be borne by the opposite party.

Send a Legal Notice and urge that besides filing a suit for recoveryyou will have to publish your grievance in media/forum, unless your grievance is redressed in a months' time.
