Mr. X is having estranged reationship with his wife, contemplating to seek  divorce from her. Meanwhile,.he wants to buy a property in the name of his two male children aged 3+ &4+. He wants to make his siter as guardian till the age of 18. Is this step legal? Can it be challanged by Mr. X's wife during divorce proeedings or there after? Please advice any better way to avoid litigation between Mr. X  sister and his estranged wife before or after the divorce.

Dear Anonymous,

In so far the entranged husband is able to take care of the hardships of the litigations i.e. payment of maintenance and allumini to my mind there seems to be no problem at all as by virtue of self acquired property after meeting out all the obligations there is no estopple in this regard and more so the step being in the right direction (for securing the future prospects of the minor child) there seems to be no legal lacuna.
