Hello,
our neighbouring plot owner constructed house in my plot instead of his plot and do not know whether it is intentional or by mistake.
he constructed 3 storey building and yet to move-in to the new house.
Now we came to know that, he has constructed house in our plot.
Kindly advise legally how can we take it forward? and let us know the available options to deal with this.

File a case under IPC for criminal trespass and file suit for recovery of property

If you have the title of the property and erronously neighbour constructed, say thanks to him/her, pay the cost or compensate, settle the case amicably, the best possible solution.
Otherwise throw him/her out (shortcut method) or
file suit for possession (a lengthy and uneconomical legal procedure)

If you have original title deed and site map of the property then hire a bulldozer and start demolishing building erected thereon illegally.

You can evict him or try the suggestion given by Dr. Vashista
