House Repair

Dear Sir / Madam, We (120 tenants) have been staying at Sewri, Mumbai since around 50 years. In 2004, Our landlord has suited a case against all tenants for not paying rent from 1991. This case is going on within the court. We agree to pay a true and fair rent to him. In 2011, he started to make developmet agreement with us. Some of tenants have made agreement but some tenants including me are not agree to make agreement until a case is resulted. At present, our house needs to be repaired as early as possible. It may collapse anytime. He doesn't grant permission to repair it even at our own cost. He seeks a chance to shift us at his own dirty and mess terrible transitcamp. He grants permission for repairing to tenants who've made agreement where as he doesn't grant permission to tenants who've not made agreement. He has been pressuring us to make agreement by not granting permission to repair the house. Our advocate advised that houses can't be repaired. Otherwise the case will turn to difficult way and the landlord will shift us at his transitcamp. Please help me by suggesting your advise. Reg, Ritesh Panchal

Hello Ritesh,

   You are paying rent for that house and you dont own it,

if the owner decides to not pay for the construction you cannot do anything ,just vacate that house and move on to a new one,

you will only go around courts for years and years and tomorrow the owner will even claim for the damage charges also if you do any kind of repairs to the house.

end of the day its not your house just get out of that and start a fewsh life in the new house.

you will not be able to do anything if the owner decides not to repair the house.
