How and when can litigation costs / opportunity costs be recovered ?

Now the status update is that the society office bearers come for a compromise but it seems that compromise may not work out since the office bearers are still insisting on commercial charges.

Any way now one of my queries is whether I can ask for

1) Litigation costs

2) Opportunity Costs

at compromise stage or later.

What is the process of recovering litigation costs & opportunity costs?
