How to delay interim Maintenance by countest

Hi,

How to delay the interim maintenance order by contesting it in higher courts. Max how long we can contest.

If filing Crpc 125(2) Interim Maintenance with false allegations, wherein we have solid proofs to prove all are baseless allegations. How to contest and avoid it.

Thanks,

Learning

Read past 100 messages on S. 125 here in LCI you will acquire sufficient knowledge on a brief where facts of parties are not at all mentioned and yet this author expects experts to reply (read as spoon feed)!

Jamai Of Law (propra)     25 April 2011

contest full with full force at appellate court (take it as a last chance. otherwise after that there becomes a 'substantial question of law'. task impossible almost at SC ... SLP etc)

First obtain stay on execution to keep paying (Not so easy) Give security interms of a guaranrty etc. Show irreparable harm to you if stay not grnated. Show misconduct of other party in regards to how she obtained this decree by fraud.

Just making allegation won't suffice,

Also sustain some pain of paying partially atleast (else you may go to jail)

Make a detailed appeal without failing to miss any point or evidence to submit.

Delay on your own won't help.

Accrual amount keeps increasing.
