How to i get my orginal certificates

Respected Sir/mam

                  i had worked in a bpo company(purely night shift) for the past 5 months and now i releaved from the company with out giving the notice period because of my health problems and also im an engineering graduate and im in a situation of to move into the software company.

when i asked about my 10th and 12th orginal certificates, they asked me to pay 20000 and also they hold my August month salary.at the time of joining i had signed in the company letter pad by saying that in will work here for 1 year incase if i get releaved from the company in will pay my one month salary. 

is there any chance to get my certificates back without paying money or it is mandatory to pay

please help me sir/mam...............thanks in advance

Retaining your originals by the company is illegal & you can lodge a police complaint, as far as your continuation with the organization or else paying the amount against violating the agreement is as per the document signed by you.  Signing any document with out understanding the implictions a hurry is the root cause for all these issues. Try to convince / get the things cleared some how or else option left over is the legal battle.

The notice period/pay is part of service conditions and is goiverned by various  enactments applicable to establishment/employer and these enactmentsshall prevail upon any private agreement/rule/policy that employer has drafted and signed with employee e.g. appointment letter/contract of employment/HR policy/service rules and regulations/service agreement/ etc!

 

BPO are covered by State Shops and Estbs Act and standing orders are applicable.

The notice period for 5 months of service might be NIL.

The notice period during probation period is NIL.

 

The original c ertificates are your propetty and employer can not have lien on it. You can lodge police complaint as well.

 

The service agreement is drafted in lieu of what extar Ordinary favor by company or it just asked you to feel obliged since job is being given to you and sign the gareement/bond? In Yes it amounts to bondedlabor that has been abolished way back.
