How to prove adultery? wife moved on..

Wife has changed her name and while the divorce case is still going on, she is living with someone else. Husband knows the fact but is unable to prove it. She made a pan card by different name and basis of that made different documents.

Now she has two totally different names with different surnames. The name which she is using is said to be the wife of that another guy and the husband is not able to prove that in court. Wife is living with other guy and his family, while the house in which wife is living is by the name of the parents of the other guy. They have made the rent agreement by the name of wife and according to that the wife is living there as a tenant.

They also made a setting in which wife is working in a firm of the other guy, so when they travel it is a business trip. Also they make bookings by that other name of wife, so that bills are not getting accepted as it has different name and also it is a business trip.

There is nothing else to prove as they living together as land lord and tenant. How to prove this?

take the services of a detective to gather proofs for the adultery being committed and with those proofs you can file criminal cases of forgery and also you can divorce her on grounds of adultery

Dear Saravanan S,

Thank you for your advice. Here the husband himself has done a job of detective by collecting the proof but as mentioned that she has played a game very well by finding the loopholes. Even proof collected will not be accepted as she has answers to all.

Q. Living with other guy?

A. As tenant and landlord

Q. Went on Holidays and stayed in hotels?

A. No. (Proof is by the name of other lady, I am not that lady.)

Hire a detective, it is not a herculian task to establish the truth.

Circumstantial evidences when they both check-in hotels and hotel register entries with help of CCTV footings will be required. You have a strong case in hand ,only a detective can help. Be ready to pay for his services

How can one person have 2 different names ??? how can she get these documents registered ??

There is a way to expose the fraud if you are guided properly which a criminal lawyer/ detective can help

Dear Born Fighter,

Thank you for your reply. Two documents are made very easily, it is not a big task in India. It is very hard to get the Hotel register and cctv footage. Also, husband is 1000kms away from wife. Distance is also an issue. After all these efforts even though if husband or a detective able to find anything then name is different, so can't do anything.

There is also no common source wherein one can provide the information whether when they went out or in the house or where they are going. They also escape easily by saying that they are collegues working in the same office as that other guy is owning a firm and she is hired in that.

One person can not have two different Pan cards and us these.

The photo shall remain to be same person.

This is fraud and forgery.

Change of name is also a procedure; Publish in gazette.

A good detective and good lawyer can poke holes in the defense.

ALl you have to do is to cross examine her on some aspectrs. Ask her whether she has any documents to establish that her new name was also her name bewfore the time she allegedly changed the same. Also ensure that you manage to place on record photographs and documents pertaining to prove that she was actually maintaining a separate identity prior to becoming involved with the new guy.

Im sorry but either you are imagining things OR u think only U are smart.

I told u to hire a detective, he will trace where your wife moves (with help of call records/mobile tower locations) and follow her. Such an expert detective will have his connections PAN India to get job done. Now pls dont tell me that such records cant be taken out as these detectives have access to same.

Also finding out if 1 person (i.e ur wife) is operating under 2 names is not difficult. Let me ask you do you know what is the other name and address ??

She may be 1000kms away or next door, if u have the money to pay the detective he will get the job done.

If u cant do all that then as advised by Adv Augustine u can expose her lies/fraud during cross examination.
