How to save oneself from 406 ?

1] can one file a petition in court  expressing willingness to hand over whatever articles wife left at her husband's home, just after filing for divorce?

2] will that help him anyway in 406 case?

3] if not is there any other way?

4] if husband in his complain doesn't say wife has taken her belongings, could they still file case under 406. what is the best legal strategy regarding belongings of wife?

 please advise.

thanks.

In the divorce petition itself the husband/petitioner can state that he is ready to handover all her belongings/articles left behind by her/in his possession as on the date.  This will help to prove his honest intention therefore the 406 case may have less impact.

well i have a slightly different situation  my wife has secretly shifted all her jewelry to her parents house as she was residing with me before filing DV case.

in high court mediation cell i have handed over all her other articles of which i have the proof .

i am really worried about the false allegation that i am still having her jewelry
