How to Treat this

I  applyed for a partition suite against my father because he have a property that was seems  like self earned property. He say's this is self earned property but acutually he sold some ancestoral property & with this amount he buy a new land and registered in his name so we take all of the sold properties document & produce in court. So we say this is an ancestoral property. My father is 86 years old his wealth is also not good  in case after his death what about the case how it willbe treated as a self earned property or Ancestoral property.  we start the suite in Dec 2007 still now he didn't giving any proper details he is accepting every thing but we don't have any written statements to proof after his death.
