Hr not accepting pay in lieu of notice period..

Dear Members,

Please help by providing solution.

I have been working with my present employer since past 15 months.  Now I have resigned and already served 1 months notice.  

As per Appointment letter " The bank alone, at its discretion may opt to make / accept payment in lieu of notice period, which will be calculated on the basis Monthly gross salary "....

Now, I am requesting my HR to relieve me or provide me a waiver of one month and take one month;s salary which they clearly rejecting saying 90 days you will have to serve.

Any way-out ... Any solution to this.

Your help would be highly appreciated.

Ask a lawyer to prepare a notice. Make it clear that this notice should be treated as resignation and append the Banker's cheque. Do not attend the job from the date the notice is received by them. Also ask them that insisting for further service amounts to force labour.
