Husband deserts wife

Sir / Madam

The query is as below :

1) Husband deserts his wife after 8 months of marriage started staying separately in another city, address unknown to wife.

2) Husband family non-cooperative and does not help either.

3) It transpires that husband has taken huge loan from banks/ creditors which was prior to marriage. The fact was not known to wife.

4) Suddenly after one year of statying separately, husbands mother calls to inform that he has expired in another city after illness.

5) Wife calls for proof, his mother sends a newspaper cutting but does not send any death certficate or other papers.

6) Under the circumsatnces whether wife can remarry citing newspaper cutting as proof as husbands family is non cooperative.

7) Otherwise what should be the course of action. Is filing of divorce case a necessity ? But it would destroy another 1/2 years of wife who has been abandoned by his husband/inlaws.

Please help with your kind advice.

Go to jurisdiction police station, file missing complaint against husband and inform facts in writing (entire story), lodge complaint against parent-in-laws that they have stated like this asking them to check the authenticity of the information, it might be so that the guy has gone absconding due to harassment from creditors, so check with police.  Once death of the person is confirmed.  Apply for death certificate with corporation or municipal council.  You approach court with death certificate of the person asking court to grant divorce so that she can re-marry.  The process will not take more than 3-4 months in total.

If above is true, every widow/widower should approach the court for remarriage??

Once the partner is expared, then whom we divorce, the dead body??
