If a case is filed in wrong jurisdiction

Dear Member,

what would be the consiquences if the case has to be filed in Kolkatta court but has wronly been filed in delhi court.(it will be under limitation act)

is it applicable for all civil suits or is it applicable for appeals only.

the Delhi High Court, will return your civil suit  with an endorsement stating that  " to present the suit in a proper court". The limitation should also be covers.

Delhi Court will do nothing but to return the case to file in proper court having jurisdiction  under order 7 rule 10 of C.P.C
