please tell me if any person husband / wife found guilty then he/she have to go jail for long time period.
as me , i have left home with my child my wife claim and highlight it .
if i agreed in court that i left with child becouse of she give threats to me to put criminal case and my mind was very much disturbed ( actually it is true). then court will punish me ????????and my parents to becouse they know about it. .( In FIR she mensioned that we are living seprate from two years.)
First of all, why the wife will be punished? She will be punished only if you file perjury. If you are convicted then no problems, you will have to go to jail for 3 years which is the punishment in 498A.
I didn't understand rest of your incidents properly. If you left home even with your kid, then this doesn't mean that you are convicted in 498A. Read the definition of 498A. Conviction will depend upon what is written in FIR and Chargesheet.
