I have few questions regarding an illegal construction,
1. Can a municipal authority sanction a building plan without showing/ marking a parking place on plan as per provisions?
2. Is any municipal officer empowered to authorize a building constructed on road setback area after stating the same as illegal in written previously?
3. Can any municipal authority issue a Occupancy certificate and completion certificate to building which has been constructed taking huge deviation from approved building plan?
4. Can builder/ architect reduce a number of car parking in the plan from 5 to 3 and Septic tank from 2 to 1?
In case if above offences are committed by builder/ architect and Municipal officers what could be the possible end result if the case is filed in Bombay High court?
